Terms and Conditions

1. The service

WeatherX Earth is an interactive 3D weather platform that displays real-time precipitation, AI radar nowcasting, snow, frost, wind, and upper-air data, produced by our proprietary weather forecasting and nowcasting technology, and derived and verified operational guidance such as "work windows" for weather-exposed activities. The Platform is offered in three tiers:

Free — explore and analyze weather data within the Free tier’s constraints (forecast window and radar depth), with no sign-up required.

Pro+ — a paid subscription with full analytical access; the only constraint on Pro+ is the number of watchlist locations you may save.

Enterprise — custom access tailored to your organization’s needs, including broadcast mode, API access, webhooks, integrations, and 4K video export, typically subject to a separate order form or Enterprise agreement. Where an Enterprise agreement conflicts with these Terms, the Enterprise agreement controls for that customer.

2. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your country) to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use of your account.

3. Subscriptions, billing, and cancellation

Pro+ is a paid subscription billed on a recurring basis (currently from €7.99/month, subject to change with notice). Payments are processed by our third-party payment processor, Stripe; by subscribing you also agree to Stripe’s applicable terms. You can cancel your subscription at any time from Account Settings → Manage Subscription. If you cancel, you will retain access to Pro+ features until the end of your current billing period. You may request a full refund within 14 days of your initial Pro+ purchase, or within 14 days of a renewal charge, by contacting [email protected]. Outside of this 14-day window, we do not provide refunds or credits for partial billing periods. We will provide reasonable advance notice before any price change takes effect on your subscription. Enterprise pricing and payment terms are set out in the applicable order form or agreement.

4. Acceptable use

You agree not to: reverse engineer, scrape, or systematically extract data from the Platform beyond what your tier or API agreement permits; resell, sublicense, or redistribute Platform data or outputs as a standalone competing weather data product without our written permission; use the Platform to violate any law, infringe third-party rights, or transmit harmful code; interfere with or disrupt the integrity or performance of the Platform; or misrepresent WeatherX data as an official government or national meteorological warning. We may suspend or terminate access for violations of this section.

5. Sharing, attribution, and exports

Free and Pro+ tiers: if you share, publish, or otherwise distribute content generated from the Platform (such as screenshots, clips, or embeds), you must include visible attribution to WeatherX. You may not remove or obscure this attribution.

Enterprise tier: Enterprise customers have access to 4K video export and other custom export capabilities as agreed in their Enterprise agreement, and are not required to include WeatherX attribution when sharing or broadcasting exported content, unless otherwise specified in that agreement.

Where attribution is required, it must take the form of the WeatherX logo placed in one of the four corners of the shared video or image, sized and positioned so that it remains clearly visible throughout. You may not remove, obscure, distort, or resize the logo in a way that makes it illegible.

In all cases, you may not present Platform outputs as your own proprietary weather data product, and you may not use Platform outputs in a way that implies WeatherX’s endorsement of your organization without our permission.

6. Enterprise, API, and webhook access

Enterprise access, including API keys, webhooks, and broadcast integrations, is intended for use consistent with your Enterprise agreement, including any usage limits, rate limits, and permitted use cases. You are responsible for keeping API keys confidential and for all activity conducted through them. We may suspend API access that exceeds agreed limits or that we reasonably believe poses a security or stability risk to the Platform.

8. Intellectual property

The Platform, including our underlying forecasting and nowcasting technology, software, visual design, and the "WeatherX Earth" name and branding, is owned by WeatherX Analytics LLC or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose. All rights not expressly granted are reserved.

9. Third-party services

The Platform relies on third-party services, including our payment processor (Stripe), Google Analytics, and cloud infrastructure providers. We are not responsible for the availability or performance of third-party services outside our control, though we will make reasonable efforts to maintain service continuity.

You agree to indemnify and hold WeatherX harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Platform, your violation of these Terms, or your violation of any applicable law or third-party right, except to the extent caused by our own breach or negligence.

13. Termination

We may suspend or terminate your access to the Platform, with or without notice, for violation of these Terms, non-payment, suspected fraud or abuse, or as needed to protect the security or integrity of the Platform. You may stop using the Platform and cancel your subscription at any time as described in Section 3. Sections that by their nature should survive termination (including Sections 7 through 12) will continue to apply.

14. Changes to the Platform or these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email to registered users or a notice on the Platform) before the changes take effect. Continued use of the Platform after changes take effect means you accept the updated Terms. We may also modify, suspend, or discontinue features of the Platform at our discretion, with reasonable notice for paid tiers where practical.

15. Governing law and disputes

These Terms, and any dispute arising out of or relating to these Terms or the Platform, are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles. You agree to the exclusive jurisdiction of the state and federal courts located in Wyoming, USA, for the resolution of any such dispute, and you waive any objection to that venue.

16. General

These Terms, together with any Enterprise agreement or order form, are the entire agreement between you and WeatherX regarding the Platform. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
